Your trust is important to us, which is why we take data protection seriously and ensure appropriate security. 1. Scope and purpose of the collection, processing and use of personal data when visiting the website www.orbiz-flex.ch

When you visit our website, our servers temporarily store every access in a log file. The following data is collected without your intervention and stored by us until it is automatically deleted after twelve months at the latest:

  • the IP address of the requesting computer
  • the date and time of access
  • the name and URL of the retrieved file
  • the website from which access was made
  • the operating system of your computer and the browser you are using

‍ This data is collected and processed for the purpose of enabling the use of our website (establishing a connection), permanently ensuring system security and stability and enabling the optimization of our Internet offering, preventing fraudulent activity or misuse on or in connection with the website, complying with the requirements of applicable laws, protecting the safety of an individual and the rights and property of the property owner, and to prevent deception or security or technical problems and for internal statistical purposes. This is our legitimate interest in data processing within the meaning of Article 6 (1) (f) GDPR. The IP address is used in particular to record the website visitor's country of residence and to set the language of the website accordingly. In addition, the IP address is evaluated for statistical purposes in the event of attacks on the network infrastructure of www.orbiz-flex.ch.

When contacting us by electronic mail (e-mail)

Information that you send to us unencrypted by electronic mail (e-mail) may be read by third parties during transmission. As a rule, we are also unable to verify your identity and do not know who is behind an email address. Legally secure communication through simple e-mail is therefore not guaranteed. Like many email providers, we use filters against unsolicited advertising (“SPAM filters”), which in rare cases automatically classify and delete normal emails as unsolicited advertising. E-mails that contain harmful programs (“viruses”) will always be automatically deleted by us.

2. Transfer of data to third parties

5. Cookies

6. Google Analytics and Google Ads

On our website, we use the web analysis service Google Analytics from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). This collects information about the surfing behavior of website visitors for marketing purposes in a purely anonymous form and sets cookies for this purpose. No personal data is collected or stored here.

Our legitimate interest in data processing lies in evaluating the use of the website, compiling website activity and other services related to website activity and Internet usage. The information generated by Google Analytics using cookies about the use of the website — including the anonymized IP address — is transmitted to a Google Inc. server in the USA. Anonymization is carried out by removing the last eight bits of the IP address, which means that it is no longer possible to uniquely assign the data provided to a specific IP address. This information is transmitted to authorities or third parties if Google is legally obliged to do so or if third parties act as service providers on behalf of Google.

You can object to the collection, processing and recording of the collected data at any time by preventing the storage of cookies by making appropriate settings in your browser.

Ads conversion tracking also uses a cookie to determine performance, which is stored on your computer for up to 30 days after you click on an ads ad. The information is limited to the total number of users who first clicked on an ad and were then redirected to a page with a conversion tracking tag. However, you will not receive any information to personally identify users. By using this website, you consent to the processing of data about you by Google in the manner described above and for the purposes set out above.

7. Other external services

Google Maps

This website uses Google Maps API, a map service provided by Google Inc. (“Google”), to display an interactive map and to create route maps. Google Maps is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

By using Google Maps, information about your use of this website (including your IP address) can be transmitted to a Google server in the USA and stored there. Google may transfer the information obtained through Maps to third parties if this is required by law or if third parties process this data on behalf of Google. Google will never connect your IP address with other data from Google. Nevertheless, it would be technically possible for Google to identify at least individual users based on the data received. It would be possible that personal data and personality profiles of users of the Google website could be processed for other purposes over which we have and cannot influence. You have the option to deactivate the Google Maps service and thus prevent data transfer to Google by deactivating JavaScript in your browser. However, we would like to point out that in this case you will not be able to use the map display on our pages.

Pipedrive

You can book a viewing appointment on our website. To request and select an appointment, we use Pipedrive's online calendar, an offer from Pipedrive OÜ, Mustamäe tee 3a, 10615 Tallinn, Estonia. When you click on the appropriate booking button, you will automatically be connected to our appointment account on Pipedrive. After choosing your appointment, confirming and entering your contact details and concerns, you will receive an email from Pipedrive confirming your appointment. Your details from the Pipedrive form, including the data you provided there, will be stored by us for the purpose of processing the request and in case of follow-up questions. This data will remain with us until you request us to delete it, withdraw your consent to store it, or the purpose for storing the data no longer applies. 8. Note on data transfers to the USA

For reasons of completeness, we would like to point out for users residing or based in Switzerland that there are monitoring measures by US authorities in the USA, which generally allow the storage of all personal data of all persons whose data has been transferred from Switzerland to the USA. This is done without differentiation, restriction or exception on the basis of the objective pursued and without an objective criterion which makes it possible to restrict US authorities' access to and subsequent use of the data to very specific, strictly limited purposes which are able to justify the intervention associated with both access to and use of this data. In addition, we would like to point out that data subjects from Switzerland have no legal remedies in the USA which would allow them to obtain access to the data concerning them and to obtain its correction or deletion, or that there is no effective judicial protection against general access rights from US authorities. We explicitly draw the person concerned's attention to this legal and factual situation in order to make an informed decision to consent to the use of their data.

For users residing in a member state of the EU, we would like to point out that the USA does not have an adequate level of data protection from the perspective of the European Union — partly due to the topics mentioned in this section. Insofar as we have explained in this privacy policy that recipients of data (such as Google, Facebook and LinkedIn) are based in the USA, we will ensure that your data is protected to an appropriate level by our partners, either through contractual arrangements with these companies or by ensuring that these companies are certified under the EU-US Privacy Shield.

9. Right to information, correction, deletion and restriction of processing; right to data portability

You have the right to receive information about the personal data that we store about you free of charge upon request. In addition, you have the right to correct incorrect data and the right to delete your personal data (“right to be forgotten”), unless this is precluded by a legal storage obligation or a permit that allows us to process the data. In accordance with Articles 18 and 21 GDPR, you also have the right to request a restriction of data processing and to object to data processing.

You also have the right to demand from us the data that you have provided to us again (right to data portability). On request, we will also share the data with a third party of your choice. 10. Retention of data

We only store personal data for as long as is necessary to fulfill our services and legal storage obligations.

We store contract data for a longer period of time, as this is required by legal storage obligations. Retention obligations that oblige us to store data arise from accounting and tax regulations. If we no longer need this data to perform the services for you, the data will be blocked. This means that the data may then only be used for accounting and tax purposes.

11. Right to lodge a complaint with a data protection supervisory authority
